Terms of Service

These Terms of Service ("Terms") govern access to and use of the website, products, and services (collectively, the "Services") of ALL IN Performance LLC, an Indiana limited liability company ("AIP"), including Client's enrolled program and any subsequent ongoing membership. These Terms apply to any individual who accesses the AIP website, books a call, or purchases the Services (the "Client"). AIP and Client are herein each referred to individually as a "party" and collectively as the "parties." By accessing the AIP website or purchasing the Services, Client agrees to be bound by these Terms. If Client does not agree to these Terms, Client should not use the AIP website or purchase the Services.

1. Acceptance of Terms

By accessing the website, booking a call, or purchasing the Services, Client confirms that they have read, understood, and agreed to these Terms and AIP's Privacy Policy. If Client is purchasing on behalf of an organization, Client represents that they have the authority to bind that organization to these Terms.

2. Description of Services

For the duration of Client's enrolled program, AIP will provide Client with the following Services:

  • Quarterly At-Home Blood Panel
  • Biological Age Testing
  • 3D Body-Fat Scan
  • Performance Assessment
  • Ongoing Dashboard Access
  • Custom Supplement Protocol
  • Supplement Platform Access
  • Personalized Training and Nutrition Plans
  • 60-Minute Results Call
  • Initial Onboarding Call
  • Access to the ALL IN Community
  • Additional coaching services, if included in Client's enrolled program, are described in Section 6 (Coaching Services)

AIP also offers additional programs and services that may be presented to Client after Client's initial purchase.

3. Eligibility

Client must be at least 18 years of age to use the AIP website and purchase the Services. By using the AIP website, Client represents and warrants that Client is at least 18 years old and legally capable of entering into binding contracts.

4. Purchases and Payment

When Client purchases a program through the AIP website, Client agrees to provide accurate and complete payment information. All payments are processed securely through Stripe. Prices for the Services are listed on the website and may change at any time without notice. Any promotions or discounts are subject to their specific terms and expiration dates.

By enrolling, Client commits to the full program fee for the entire term of Client's enrolled program, regardless of the payment structure selected at checkout (e.g., pay-in-full or installment plan). Installment plans are a payment convenience only and do not reduce or eliminate Client's total financial obligation. The full program fee remains due even if Client discontinues participation prior to the end of the enrolled program's term. Payment is due according to the payment structure selected at checkout. A 5-day grace period applies after each due date, after which AIP reserves the right to pause Client's access to the Services until the outstanding balance is resolved.

Client authorizes AIP to securely store Client's payment method on file with AIP's payment processor for the duration of Client's enrolled program. AIP will not charge Client for a new or additional program without Client's affirmative authorization at the time of that purchase.

5. Refund Policy

AIP stands behind the quality of its programming and is committed to delivering a high-quality client experience. Any client who is dissatisfied with the program may submit a refund request in writing to the email address provided on AIP's Contact Us page. Prior to processing, AIP requires a brief call with Client to discuss Client's experience and ensure every opportunity has been made to address Client's concerns. If approved, refunds will be processed within approximately 7-10 business days of approval, using Client's original payment method.

Client's program includes third-party or external services, such as blood testing and custom supplement protocol development. Fees related to these services are non-refundable, as they reflect costs incurred by AIP in connection with such third-party services.

6. Coaching Services (If Applicable)

If Client's enrolled program includes Coaching Services, whether included as part of Client's program or added on an ongoing basis, AIP will provide:

  • Scheduled one-on-one coaching calls per the program cadence
  • Direct messaging support from coaching staff via designated channels
  • Ongoing feedback, form review, and programming adjustments as needed

Coaching Services do not include: in-person training sessions; medical diagnosis, treatment, or prescription of any kind; registered dietitian or clinical nutrition counseling services; licensed mental health counseling or therapy; or emergency and crisis support services.

To receive the full benefit of Coaching Services, Client agrees to:

  • Follow the programming and nutrition guidance provided. AIP is not responsible for outcomes resulting from non-adherence.
  • Attend scheduled coaching touchpoints and communicate questions or concerns through AIP's designated channels.
  • Provide complete, accurate health history and notify AIP promptly of any medical changes, new injuries, or medications that may affect Client's programming.
  • Submit progress photos and measurements as requested.
  • Engage with AIP staff professionally and respectfully.

7. Medical Disclaimer & Assumption of Risk

AIP and its coaches are not health care providers, and nothing provided by AIP constitutes medical advice, diagnosis, or treatment. The information provided through the Services, including but not limited to blood panel results, body composition data, supplement protocols, and training or nutrition plans, is for educational and informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Client represents that they are physically capable of participating in AIP's program and accepts full responsibility for obtaining any physician clearance Client deems necessary. Client should always consult with a licensed healthcare provider before making any changes to Client's health regimen, supplement use, or training program, and should never disregard professional medical advice or delay seeking it because of something read or received through the Services.

To the fullest extent permitted by law, Client voluntarily assumes all risks inherent in fitness training and Client's participation in the program and Services provided by AIP, including but not limited to overexertion, injury, or illness, and releases AIP and its coaches from any and all claims, damages, or liabilities arising from Client's participation, including those arising from negligence.

8. Results Disclaimer

Results from AIP's programs are not guaranteed and may vary based on individual effort, biology, adherence to the program, starting health status, and other factors unique to each person. Testimonials, case studies, and examples on the AIP website or in AIP's marketing materials represent individual experiences and are not a promise or guarantee of similar results for any other person.

9. Communication

Primary communication will occur through AIP's designated channels, which will be established at the start of Client's program. AIP staff will attempt to respond to most messages within 24 hours, provided that response times may be longer on weekends and holidays. AIP is not a crisis or emergency service, nor is AIP authorized to practice medicine or give professional medical advice. If Client is experiencing a medical emergency, Client should contact 911 immediately.

10. SMS and Email Communications

By providing a phone number and email address and consenting to receive communications, Client agrees to receive SMS and email messages from AIP regarding Client's purchase and the Services. Message and data rates may apply for SMS. Reply STOP to opt out of SMS at any time. See AIP's SMS Terms for full details.

11. Intellectual Property & Confidentiality

All workout plans, guides, videos, written content, and similar materials provided by AIP or its coaches ("AIP Program Materials"), as well as all website content including text, graphics, logos, images, and software, are the exclusive property of AIP or its content creators and are protected by intellectual property laws. Client receives a personal, non-transferable license to use AIP Program Materials for Client's own program participation only. Sharing, reproducing, distributing, modifying, or reselling AIP Program Materials or website content without AIP's prior written consent is prohibited and constitutes a material breach of these Terms, and may subject Client to legal action including injunctive relief and monetary damages. This Section 11 survives any termination of Client's relationship with AIP.

12. Consent to Use of Photos & Testimonials

By purchasing the Services, Client consents to AIP's use of transformation photos, progress images, and written or recorded testimonials of Client for AIP's marketing and promotional purposes across any media channel, including but not limited to social media, the AIP website, and email. Client's last name and direct contact information will not be published without additional consent.

Client may revoke or limit this consent at any time by notifying AIP in writing at the email address on AIP's Contact Us page. AIP agrees to consider such requests in good faith but reserves the right to grant or deny requests to remove previously published content at its discretion, in compliance with applicable law.

13. Termination

Either party may terminate Client's enrolled program upon 30 days' prior written notice. Voluntary termination by Client does not relieve Client of any outstanding payment obligations for the full program fee described in Section 4. In the event AIP terminates Client's enrolled program for convenience, Client will receive a prorated refund for any program time or Services not yet delivered.

AIP may immediately restrict Client's access to the Services or terminate Client's enrolled program without refund based on Client's material breach of these Terms, misrepresentation, or abusive or disrespectful conduct toward AIP staff, coaches, or other members of the AIP community.

14. Limitation of Liability & Indemnification

To the fullest extent permitted by law, AIP and its employees, partners, coaches, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from Client's use of or inability to use the Services, including but not limited to any health outcomes, financial losses, or loss of data, or arising from AIP's use of any third-party service (including payment processors, blood testing labs, or supplement fulfillment platforms). Client uses the Services at Client's own risk.

Client agrees to indemnify and hold harmless AIP and its employees, partners, coaches, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from Client's use of the AIP website or the Services, Client's violation of these Terms, or Client's violation of any rights of another party.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. In the event of any dispute, the party raising the dispute will notify the other party, and both parties will negotiate in good faith to resolve the dispute within 30 days of such notice. Any dispute not resolved through good-faith negotiation shall be resolved exclusively in the state or federal courts located in Marion County, Indiana, and Client irrevocably consents to personal jurisdiction and venue in such courts.

16. Changes to These Terms

AIP may update these Terms from time to time. AIP will notify Client of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Client's continued use of the AIP website or Services after changes are posted constitutes Client's acceptance of the updated Terms.
